Assessment for Road Sealing Project

As voted on by the Plantation Point Community Assocation Board we will assessing all home owners $100.00 for the upcoming road sealing project.  Homeowners will also receive a letter/invoice stating this as well.

What happened to the funding that was in the account for this project?

Section 3. (a) In addition to annual General Assessments authorized above, the Association
may levy in any assessment year, a Special Assessment for the purpose of
defraying, in whole or in part, the cost of any construction,
reconstruction, repair or replacement of a capital improvement upon the
Common Areas, including personal property related thereto, provided that such
assessment shall have been approved by seventy-five percent (75%) of the
Members of the Association at a meeting at which a quorum was present, and
further provided, that such assessment shall not exceed $100.00 per Lot per year.

This is not an Emergency Assessment… So we need to discuss this further before collecting any funds…

To all Residents of PP community… We still have not resolved the issue from the Board of Directors of our HOA with regard to assessments being placed or enforced. The road project assessment is clearly in violation of our covenants and must be rescinded before any legal action occurs which will only exacerbate this situation. I am being most direct in saying that due in fact this is not an “Emergency” assessment… then the board must require a meeting of at least 75% or more home owners to place their vote.

If the Board fails to abide by the covenants that are set forth, then a Motion at the next annual meeting will be presented to abolish the HOA and the Board. I will ask all homeowners to read Section 3. (a) and understand the language that was agreed and voted upon by we the homeowners.

The Board is determined to change the language of the assessment by saying that this is an “Emergency” assessment from the hurricane. So be the case if that assessment was presented within 30 days after the storm damage. That did not occur. This road project is preventative maintenance to help preserve the condition of the roadway as is…

Any and all assessments collected are not considered an agreement to the board decision and must be held and/or returned to the resident(s) unless the Homeowners vote otherwise and approve the assessment.
